DMCA Policy

Yalimonium respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), Yalimonium will respond promptly to claims of copyright infringement that are reported to our designated copyright agent identified below.

If you are a copyright owner, or authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Yalimonium platform by completing the following Notice of Alleged Infringement and delivering it to our designated copyright agent.

To file a notice of alleged copyright infringement with us, you must provide a written communication that includes substantially all of the following:

• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
• Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If you believe that material you posted on the Yalimonium platform was removed or access to it was disabled by mistake or misidentification, you may file a counter-notice with us by submitting written notification to our copyright agent that includes substantially all of the following:

• Your physical or electronic signature.
• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the relevant authority and that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receiving a valid counter-notice, we will forward it to the original complaining party. The original complainant will then have a period of time to notify us that they have filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on our platform. If we do not receive such notification within the applicable period, we may, in our sole discretion, restore the removed material.

It is the policy of Yalimonium to terminate, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. Yalimonium may also, at its sole discretion, limit access to the platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, regardless of whether there is any repeat infringement.

Yalimonium reserves the right to modify, disable access to, or remove any content, in whole or in part, that it deems in its sole discretion to infringe upon another party's copyright, or otherwise in violation of this DMCA Policy, at any time without notice.

Yalimonium is not in a position to adjudicate disputes between third parties and does not assume any obligation to do so. Yalimonium's response to a DMCA takedown notice or counter-notice does not constitute legal advice. If you are uncertain about whether particular material infringes a copyright held by you or another, we encourage you to consult an attorney before submitting a notification or counter-notification.

Filing a false claim of copyright infringement or a false counter-notice may result in legal liability, including damages, court costs, and attorneys' fees.
